Allgemeine Geschäftsbedingungen für die Anmeldung zur Fortbildung Fußballmedizin Modul 9 der DFB-Akademie der DFB GmbH & Co. KG ("DFB")

I. Geltungsbereich

Für die Geschäftsbeziehung zwischen dem DFB und dem/der sich zur Fortbildung anmeldenden Teilnehmer*in gelten ausschließlich die nachfolgenden Allgemeinen Geschäftsbedingungen in ihrer zum Zeitpunkt der Buchung gültigen Fassung. Abweichende Bedingungen der Teilnehmenden werden nicht anerkannt, es sei denn, der DFB stimmt ihrer Geltung ausdrücklich zu.

II. Teilnahmebedingungen

1. Anmeldeverfahren und –bedingungen

Voraussetzung für die gültige Anmeldung und Teilnahme ist eine wirksame Registrierung, die ausschließlich über die vom DFB erstellte Forms-Abfrage erfolgt. Die Teilnehmer*innen erhalten diese integriert in der Einladung. Darin enthalten sind sowohl der Anmeldelink für die Forms-Abfrage als auch der Link zur Landingpage der Fortbildung Fußballmedizin. In der Forms-Abfrage sind persönliche Daten, Rechnungsanschrift zu hinterlegen, AGB und Datenschutzhinweise einzusehen und die Teilnahme zu bestätigen. Über den Button „Absenden“ stellt der/die Teilnehmer*in einen Antrag auf Teilnahme an der Veranstaltung. Dieser Antrag wird nur wirksam abgegeben und übermittelt, wenn der/die Teilnehmer*in

  • alle Pflichtfelder ausgefüllt hat
  • das Häkchen in der Checkbox „Ich nehme an der Fortbildung Fußballmedizin der DFB-Akademie teil (Preis: EUR 297,50 [EUR 250,00 netto])“ gesetzt hat
  • die Checkbox „Ich habe die AGB zur Kenntnis genommen“ anerkannt hat

Der Vertrag kommt erst durch den Versand der Rechnung (siehe Ziff. 3. Bezahlung) per E-Mail durch den DFB zustande. Anträge werden in der Reihenfolge ihres Eingangs beim DFB berücksichtigt. Eine Stornierung ist danach nur noch unter den in Ziff. 5. genannten Bedingungen möglich. Nimmt der DFB den Antrag nicht an, etwa wenn die Veranstaltung bereits ausgebucht ist, wird der/die Teilnehmer*in hierüber gesondert informiert. In manchen Fällen kann er/sie sich auf einer Warteliste vermerken lassen.

2. Kosten
Die Teilnahmegebühren zur Teilnahme an der Fortbildung betragen 250,-- € netto zzgl. MwSt. In diesem Preis sind die Fortbildungsgebühr sowie der Zugang zum Online Campus, der die Onlineveranstaltung technisch ermöglicht, enthalten.

3. Bezahlung
Im Anmeldeprozess über die Forms-Abfrage werden die Rechnungsdaten der Teilnehmer*innen abgefragt. Nach der Anmeldeüberprüfung erhält der/die Teilnehmer*in eine Rechnung per E-Mail, die gleichzeitig als finale Anmeldebestätigung gilt. Die Bezahlung erfolgt vorab.

4. Stornierung
Tritt der/die Teilnehmer*in nach verbindlicher Anmeldung von der Buchung zurück, ist eine Erstattung der Teilnahmegebühren nur bis zum 02.05.2023 kostenfrei möglich. Ab dem 03.05.2023 berechnet der DFB eine pauschale Stornogebühr in Höhe von 100 % der Teilnahmegebühr, soweit der/die Teilnehmer*in nicht nachweist, dass der entstandene Schaden niedriger ist als die pauschale Stornogebühr. Bei Verhinderung des/der Teilnehmers/Teilnehmerin kann ein gebuchter Platz in Absprache mit dem DFB auch an eine/n andere/n Ersatzteilnehmer*in weitergegeben werden. Hierüber ist der DFB umgehend schriftlich zu informieren (medizinertagung@dfb.de).

5. Leistungen
Die Teilnahmegebühren beinhalten die Teilnahme an der Fortbildung "Fußballmedizin" Modul 9 am 10., 11. und 12. Mai 2023 über den DFB ONLINE CAMPUS. Einzelne Leistungen können nicht individuell gebucht werden.

6. Verlegung / Absagen
Der DFB behält sich das Recht vor, die Veranstaltung bei höherer Gewalt, bei nicht ausreichender Teilnehmerzahl oder kurzfristiger Absage eines oder mehrerer Referierender abzusagen. Der/Die Teilnehmer*in erhält in diesen Fällen unverzüglich eine entsprechende Information. Bereits gezahlte Gebühren werden erstattet. Eine weitergehende Erstattung (Schadenersatz, Aufwendungsersatz, etc.) ist ausgeschlossen, soweit sie nicht auf Vorsatz oder grobe Fahrlässigkeit zurückzuführen ist. Programmänderungen bleiben vorbehalten. Ein Wechsel der Dozenten*innen berechtigt den/die Teilnehmer*in weder zum Rücktritt von diesem Vertrag noch zur Minderung der gemäß Ziff. 2 dieser AGB zu entrichtenden Gebühr.

7. Ausschluss von der Teilnahme
Der DFB behält sich vor, Teilnehmer*innen in besonderen Fällen, z.B. Zahlungsverzug, von der weiteren Teilnahme an der Veranstaltung auszuschließen. Aus organisatorischen Gründen gilt der 09. Mai 2023 als Stichtag für den Zahlungseingang der Teilnehmer*innen.

8. Bildrechte
Durch seine/ihre Anmeldung willigt der/die Teilnehmer*in ein, dass von ihm/ihr am 10., 11. und 12. Mai 2023 anlässlich dieser Online-Veranstaltung gefertigte Bild- und Bewegtbildaufnahmen bzw. Reproduktionen dieser Aufnahmen durch den DFB und seine Partner auf sämtlichen Plattformen und Kanälen, inklusive der sozialen Netzwerke des DFB und seiner Partner, veröffentlicht werden dürfen. Die Einwilligung erstreckt sich auf eine Veröffentlichung sowohl zu kommerziellen als auch zu nicht-kommerziellen Zwecken im Zusammenhang mit der Veranstaltung, insbesondere auch auf die Vermarktung weiterer vergleichbarer Veranstaltungen. Die erteilte Einwilligung ist jederzeit frei widerruflich. Ein Widerruf ist dem DFB gegenüber schriftlich zu erklären (medizinertagung@dfb.de).

9. Haftung
Der DFB haftet für entstehende Schäden lediglich, soweit diese auf einer Verletzung einer wesentlichen Vertragspflicht oder auf einem vorsätzlichen oder grob fährlässigen Verhalten durch ihn, seine gesetzlichen Vertreter oder Erfüllungsgehilfen beruht. Wird eine wesentliche Vertragspflicht leicht fahrlässig verletzt, so ist unsere Haftung auf den vorhersehbaren vertragstypischen Schaden begrenzt. Eine wesentliche Vertragspflicht ist bei Verpflichtungen gegeben, deren Erfüllung die ordnungsgemäße Durchführung des Vertrages erst möglich macht oder auf deren Einhaltung der/die Teilnehmer*in vertraut hat und vertrauen durfte.
Eine darüber hinausgehende Haftung auf Schadensersatz ist ausgeschlossen. Die Haftung wegen schuldhafter Verletzung von Leben, Körper oder Gesundheit nach den gesetzlichen Bestimmungen bleibt unberührt.
Alle von den Teilnehmer*innen angegebenen Daten werden nur für die Zwecke der Fortbildung sowie unter Berücksichtigung der geltenden EU-Datenschutzgrundverordnung (DSGVO) verarbeitet. Nähere Informationen sind unter www.dfb.de/datenschutzerklaerung zu finden. Nach Durchführung der Fortbildung werden alle Daten vollständig gelöscht. Der/die Teilnehmer*in kann jederzeit Auskunft nach Art. 15 DSGVO über seine/ihre verarbeiteten personenbezogene Daten verlangen. Möchten Sie von Ihrem Auskunfts- oder Widerspruchsrecht Gebrauch machen, genügt eine E-Mail an datenschutz@dfb.de.

III. Schlussbestimmungen
Für die Geschäftsbeziehung zwischen dem DFB und dem/der Teilnehmer*in gilt deutsches Recht. Ist der/die Vertragspartner*in Kaufmann im Sinne des HGB, juristische Person des öffentlichen Rechts oder öffentlich-rechtliches Sondervermögen, hat er/sie keinen allgemeinen Gerichtsstand im Inland oder ist sein/ihr Wohnsitz oder gewöhnlicher Aufenthaltsort im Zeitpunkt der Klageerhebung nicht bekannt, so ist der ausschließliche Gerichtsstand für alle Auseinandersetzungen aus und in Zusammenhang mit dem Vertragsverhältnis Frankfurt am Main. Sollten einzelne Punkte dieser Allgemeinen Geschäftsbedingungen ganz oder teilweise unwirksam, undurchführbar oder nicht durchsetzbar sein oder werden, so wird dadurch die Gültigkeit des Vertrags und der übrigen Bedingungen nicht berührt.

General Terms and Conditions for the registration for the further education Football Medicine Module 9 of the DFB Academy of the DFB GmbH & Co. KG ("DFB")

I. Scope of application

The following General Terms and Conditions in the version valid at the time of booking shall apply exclusively to the business relationship between the DFB and the participant registering for the training course. Deviating terms and conditions of the participants shall not be recognised unless the DFB expressly agrees to their validity.

II. Conditions of participation 

1. Registration procedure and conditions
The prerequisite for valid registration and participation is effective registration, which is carried out exclusively via the forms query created by the DFB. The participants will receive this integrated in the invitation. It contains both the registration link for the Forms query and the link to the landing page of the advanced training course in football medicine. In the form query, personal data and billing address must be entered, the general terms and conditions and data protection information must be viewed and participation must be confirmed. By clicking on the button "send", the participant submits an application for participation in the event. This application is only validly submitted and transmitted if the participant has

  • has filled in all mandatory fields
  • has ticked the checkbox "I am participating in the advanced training course in football medicine of the DFB Academy (price: EUR 297.50 [EUR 250.00 net)
  • has acknowledged the checkbox "I have taken note of the general terms and conditions

The contract is only concluded when the invoice (see section 3. Payment) is sent by e-mail by the DFB. Applications will be considered in the order in which they are received by the DFB. Cancellation is only possible thereafter under the conditions stated in section 5. If the DFB does not accept the application, for example if the event is already fully booked, the participant will be informed separately. In some cases, he/she may be placed on a waiting list.

2. Costs
The participation fee for the further education is 250,-- € net plus VAT. This price includes the training fee and access to the Online Campus, which makes the online event technically possible.

3. Payment
During the registration process, the participant's invoice data will be requested via the Forms query. After the registration has been checked, the participant will receive an invoice by e-mail, which is also the final confirmation of registration. Payment is made in advance.

4. Cancellation
If the participant cancels the booking after binding registration, the participation fees can only be refunded free of charge until 02.05.2023. From 03.05.2023 onwards, the DFB will charge a flat-rate cancellation fee of 100% of the participation fee, unless the participant can prove that the loss incurred is lower than the flat-rate cancellation fee. If the participant is prevented from attending, a booked place can be given to another substitute participant in consultation with the DFB. The DFB must be informed immediately in writing (medizinertagung@dfb.de).

5. Services
The participation fees include participation in the advanced training course "Football Medicine" Module 9 on 10, 11 and 12 May 2023 via the DFB ONLINE CAMPUS. Individual services cannot be booked individually.

6. Postponement / Cancellation
The DFB has the right to cancel the event in the event of force majeure, insufficient number of participants or cancellation at short notice by one or more speakers. In such cases, the participant will be informed immediately. Any fees already paid will be refunded. Any further reimbursement (compensation for damages, reimbursement of expenses, etc.) is excluded, unless it is due to intent or gross negligence. The programme is subject to change. A change of lecturers does not entitle the participant to withdraw from this contract or to reduce the fee payable in accordance with point 2 of these General Terms and Conditions. 

7. Exclusion from participation 
The DFB reserves the right to exclude participants from further participation in the event in special cases, e.g. late payment.
For organisational reasons, the deadline for receipt of payment from participants is 9 May 2023.

8. Image rights 
By registering, the participant consents to the publication by the DFB and its partners on all platforms and channels, including the social networks of the DFB and its partners, of images and moving images taken of him/her on the occasion of this online event on 10, 11 and 12 May 2023 or reproductions of these images. The consent extends to publication for both commercial and non-commercial purposes in connection with the event, in particular also to the marketing of other comparable events. The consent granted may be freely revoked at any time. Revocation must be declared to the DFB in writing (medizinertagung@dfb.de).

9. Liability / Data Protection
The DFB shall only be liable for any damage incurred insofar as this is based on a breach of a material contractual obligation or on intentional or grossly negligent conduct on the part of the DFB, its legal representatives or vicarious agents. If an essential contractual obligation is breached due to slight negligence, our liability shall be limited to the foreseeable damage typical for the contract. An essential contractual obligation is given in the case of obligations whose fulfilment makes the proper execution of the contract possible in the first place or on whose compliance the participant has relied and was entitled to rely.
Any further liability for damages is excluded. Liability for culpable injury to life, body or health in accordance with the statutory provisions remains unaffected.
All data provided by participants will only be processed for the purposes of the training and in compliance with the applicable EU Data Protection Regulation (DSGVO). Further information can be found at www.dfb.de/datenschutzerklaerung. All data will be completely deleted after the training has taken place. Participants may request information on their personal data processed at any time in accordance with Art. 15 DSGVO. If you would like to make use of your right of access or objection, simply send an email to datenschutz@dfb.de.

III. Final provisions
German law shall apply to the business relationship between the DFB and the participant. If the contractual partner is a merchant within the meaning of the German Commercial Code (HGB), a legal entity under public law or a special fund under public law, if he/she has no general place of jurisdiction in Germany or if his/her place of residence or habitual abode is unknown at the time the action is brought, the exclusive place of jurisdiction for all disputes arising from and in connection with the contractual relationship shall be Frankfurt am Main. Should individual points of these General Terms and Conditions be or become invalid, unenforceable or unenforceable in whole or in part, this shall not affect the validity of the contract and the remaining conditions.
